{"id":11030,"date":"2018-09-14T12:33:10","date_gmt":"2018-09-14T06:48:10","guid":{"rendered":"http:\/\/pahichan.com\/?p=11030"},"modified":"2018-09-14T12:33:10","modified_gmt":"2018-09-14T06:48:10","slug":"what-is-happening-to-lgbti-rights-in-malaysia","status":"publish","type":"post","link":"https:\/\/pahichan.com\/en\/what-is-happening-to-lgbti-rights-in-malaysia\/","title":{"rendered":"What is happening to LGBTI rights in Malaysia?"},"content":{"rendered":"<p>Kathmandu (Pahichan) September 14 &#8211; More than four months after a historic change in government in Malaysia, the LGBTI community is bemoaning a backsliding in rights in the country.<\/p>\n<p>Malaysia\u2019s new leader Mahathir Mohamed promised, with his Pakatan Harapan coalition, to tackle human rights and launch \u2018Malaysia Baru\u2019, a New Malaysia.<\/p>\n<p>\u2018The reality is nothing changes\u2019 an LGBTI actor and director in capital Kuala Lumpur told Gay Star News. \u2018I still don\u2019t feel like a worthwhile citizen\u2019.<\/p>\n<p>In the last two months, Malaysia caned two women for attempting lesbian sex. Police also raided the oldest gay club in the country. What\u2019s more, ministers and politicians have spoken out against the LGBTI community.<\/p>\n<p>\u2018The LGBT community, long persecuted by the previous regime, has not received any respite in Malaysia Baru\u2019 transgender group Justice for Sisters said this month.<\/p>\n<p>\u2018If anything, we have seen a deterioration of LGBTI rights since Pakatan Harapan came into power\u2019, researcher for Amnesty International, Rachel Chhoa-Howard, told Gay Star News.<\/p>\n<p>Significantly, homosexuality is illegal in Malaysia under Section 377 of the Penal Code. Its similar colonial-era legislation to the anti-gay law that India dismantled last week.<\/p>\n<p>A 2013 survey found 86 percent of Malaysians believed homosexuality should not be socially accepted. Photo: Facebook\/Kementerian Wilayah Persekutuan<\/p>\n<\/div>\n<h2>What has happened?<\/h2>\n<p>In July,\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/lgbti-activist-forced-to-resign-from-ministers-office-because-hes-gay\/#gs.RjzY1oU\" target=\"_blank\" rel=\"noopener\">Numan Afifi, an LGBTI activist working for the sports minister, quit his position<\/a>. \u2018The backlash and threats from opposition propagandists have made it impossible for me to exercise my duties,\u2019 he wrote in a statement.<\/p>\n<p>In early August,\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/portraits-of-lgbti-activists-removed-from-art-expo-in-malaysia\/#gs._eoGeIU\" target=\"_blank\" rel=\"noopener\">officials removed portraits of two LGBTI activists from a photography exhibition in Panang<\/a>. The Religious Afffairs Minister said \u2018we do not support the promotion of LGBT culture in Malaysia\u2019.<\/p>\n<p>The same month, a<a href=\"https:\/\/www.gaystarnews.com\/article\/police-raid-malaysias-oldest-gay-club-for-the-first-time-in-its-30-year-history\/#gs.zUAjDCI\" target=\"_blank\" rel=\"noopener\">uthorities raided iconic gay club, Blue Boy, in the capital Kuala Lumpur<\/a>. Police had not raided the club in its 30-year history.<\/p>\n<p>Most noteworthy, conservative\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/malaysia-canes-two-women-for-lesbian-sex\/#gs.13whV1A\" target=\"_blank\" rel=\"noopener\">Terengganu state caned two women for attempting lesbian sex<\/a>. Malaysia\u2019s Syariah Court sentenced them. Worryingly,\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/second-malaysian-states-wants-to-cane-lgbti-people-after-lesbians-caned\/#gs.ENiee8M\" target=\"_blank\" rel=\"noopener\">a second state in Malaysia, Pahang, said it was also considering caning for LGBTI \u2018crimes\u2019<\/a>.<\/p>\n<p>Rights advocates have denounced the declining situation.\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/war-of-words-over-lgbti-rights-in-malaysia-continues\/#gs.lF3SoTw\" target=\"_blank\" rel=\"noopener\">The government has offered vague and often conflicting responses to the community.<\/a><\/p>\n<p>\u2018The government seems to be quite defensive about LGBT rights issues as if they fear being politically attacked if they defend LGBT people\u2019, Phil Robertson of Human Rights Watch (HRW) Asia told gay star news.<\/p>\n<p>Prime Minister Mahathir denounced this month\u2019s caning. Photo: Facebook<\/p>\n<\/div>\n<h2>What is next?<\/h2>\n<p>A coalition of LGBTI rights groups in Malaysia called on Pakatan Harapan to respect its manifesto. It pledged to \u2018make our human rights record respected by the world\u2019.<\/p>\n<p>\u2018It is incumbent upon our elected leaders to lead the way in ensuring that the fundamental liberties enshrined in the Federal Constitution guarantee protection for all Malaysians\u2019, they said in a statement.<\/p>\n<p>Meanwhile, the Malaysian Bar Council and the Joint Action Group for Gender Equality (JAG) separately called on the government to cease corporal punishment after the caning.<\/p>\n<p>JAG called on the new government to \u2018show the political will and courage to once and for all deal with the implications of such intrusive moral policing laws\u2019.<\/p>\n<p>Furthermore, international rights groups called on Malaysia to end rights-abusing laws. Robertson from HRW encouraged LGBTI Malaysians to work with the UN, diplomats, civil society groups, and the media.
