{"id":12123,"date":"2019-07-03T14:25:49","date_gmt":"2019-07-03T08:40:49","guid":{"rendered":"https:\/\/pahichan.com\/?p=12123"},"modified":"2019-07-03T14:26:29","modified_gmt":"2019-07-03T08:41:29","slug":"facebook-disney-and-more-companies-declare-support-for-lgbti-employees","status":"publish","type":"post","link":"https:\/\/pahichan.com\/en\/facebook-disney-and-more-companies-declare-support-for-lgbti-employees\/","title":{"rendered":"Facebook, Disney, and more companies declare support for LGBTI employees"},"content":{"rendered":"<p>Kathmandu (Pahichan) July 3 &#8211; Over <strong>200 businesses and companies<\/strong>\u00a0in the United States\u00a0<strong>filed a brief with the Supreme Court<\/strong>\u00a0in\u00a0<strong>support of LGBTI employees<\/strong>\u00a0suing for workplace discrimination.<\/p>\n<p>In April, the Supreme Court\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/us-supreme-court-will-finally-decide-on-lgbti-employment-discrimination\/\">announced it would review three cases<\/a>\u00a0regarding LGBTI equality and discrimination at places of employment. Many hope this will settle the debate of the\u00a0<strong>Title VII of the Civil Rights Act.<\/strong>\u00a0Title VII grants federal protections against discrimination for certain identities, but people disagree whether it applies to sexual orientation and gender identity.<\/p>\n<p>Prior to lawyers\u2019 arguments, interested parties can file an amicus brief as amici curiae, or \u2018friends of the court\u2019.<\/p>\n<p>206 companies filed an\u00a0<strong><a href=\"https:\/\/assets2.hrc.org\/files\/assets\/resources\/Title-seven-business-amicus-brief.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">amicus brief<\/a><\/strong>\u00a0on Tuesday (2 July) on behalf of the LGBTI employees suing their employers.<\/p>\n<p>These companies include the likes of Facebook, Disney, Apple, Coca-Cola, Amazon, Google, and more.<\/p>\n<h2><strong>What they say about LGBTI employees<\/strong><\/h2>\n<p>\u2018These businesses\u2026 share a common interest in equality because they know that ending discrimination in the workplace is good for business, employees, and the U.S. economy as a whole,\u2019 the brief begins.<\/p>\n<p>\u2018Amici support the principle that no one should be passed over for a job, paid less, fired, or subjected to harassment or any other form of discrimination based on their sexual orientation or gender identity. Amici\u2019s commitment to equality is violated when any employee is treated unequally because of their sexual orientation or gender identity. When workplaces are free from discrimination against LGBT employees, everyone can do their best work, with substantial benefits for both employers and employees.\u2019<\/p>\n<p>In all three cases under review, employers fired the employees allegedly for their sexual orientation or gender identity.<\/p>\n<p>Lower courts have both ruled in favor of the employees, and also denied their appeals. This lack of consistency and agreement is a factor in the Supreme Court\u2019s decision to take up the cases.<\/p>\n<h2><strong>\u2018Sending a clear message\u2019<\/strong><\/h2>\n<p>Jay Brown, Senior Vice President for Programs, Research and Training for the HRC Foundation, said the brief sends a \u2018clear message\u2019.<\/p>\n<p>\u2018With so much progress on the line, we are grateful that so many major American companies are standing up for the rights and dignity of their LGBTQ employees, family members and customers,\u2019 Brown continued.<\/p>\n<p>Lambda Legal Senior Attorney Omar Gonzalez-Pagan added: \u2018When employees can safely bring their whole selves to the workplace, they do better work and that leads to success.\u2019<\/p>\n<p>These companies and LGBTI organizations stand in opposition to the Trump administration, which has declared that Title VII does not apply to either\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/trumps-justice-department-says-1964-civil-rights-act-not-apply-gay-people\/\">sexual orientation<\/a>\u00a0or\u00a0<a href=\"https:\/\/www.gaystarnews.com\/article\/businesses-can-discriminate-against-trans-workers-says-us-justice-department\/\">gender identity<\/a>.<\/p>\n<p>The Supreme Court currently has a conservative majority.
