{"id":4952,"date":"2016-04-14T15:10:55","date_gmt":"2016-04-14T09:25:55","guid":{"rendered":"http:\/\/pahichan.com\/?p=4952"},"modified":"2016-04-14T15:10:55","modified_gmt":"2016-04-14T09:25:55","slug":"judge-in-china-rules-gay-couple-cannot-marry","status":"publish","type":"post","link":"https:\/\/pahichan.com\/en\/judge-in-china-rules-gay-couple-cannot-marry\/","title":{"rendered":"Judge in China Rules Gay Couple Cannot Marry"},"content":{"rendered":"<p style=\"text-align: justify;\">BEIJING\/Pahichan\u2014 A judge ruled on Wednesday against a gay couple who had sought the right to marry, in <a class=\"meta-loc\" title=\"More news and information about China.\" href=\"http:\/\/topics.nytimes.com\/top\/news\/international\/countriesandterritories\/china\/index.html?inline=nyt-geo\">China<\/a>\u2019s first court case addressing the issue of same-sex unions.<!--more--><\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"235\" data-total-count=\"400\"><a href=\"http:\/\/pahichan.com\/wp-content\/uploads\/2016\/04\/14CHINA.jpg\" rel=\"attachment wp-att-4953\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-4953\" src=\"http:\/\/pahichan.com\/wp-content\/uploads\/2016\/04\/14CHINA-300x200.jpg\" alt=\"14CHINA\" width=\"300\" height=\"200\" srcset=\"https:\/\/pahichan.com\/en\/wp-content\/uploads\/2016\/04\/14CHINA-300x200.jpg 300w, https:\/\/pahichan.com\/en\/wp-content\/uploads\/2016\/04\/14CHINA.jpg 675w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>The couple, Sun Wenlin and Hu Mingliang, <a href=\"http:\/\/www.nytimes.com\/2016\/01\/28\/world\/asia\/couples-lawsuit-is-first-test-for-same-sex-marriage-in-china.html\">filed a lawsuit<\/a> against a civil affairs bureau in Changsha, Hunan Province, in southern China, after the office refused to grant them the right to marry when they tried to register in June 2015.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"363\" data-total-count=\"763\">In a surprising move, a district court accepted the case early this year, the first time a Chinese court had agreed to hear such a lawsuit. An initial hearing scheduled for January was postponed. The court held a hearing on Wednesday morning, and the judge issued a ruling a few hours later. News of the ruling began circulating on social media shortly afterward.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"137\" data-total-count=\"900\">Mr. Sun said in an interview that he and Mr. Hu planned to appeal. They will have to do so in the next 15 days, according to Chinese law.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"133\" data-total-count=\"1033\">Mr. Sun said that he had argued that he and Mr. Hu should be allowed to marry since the law did not explicitly ban <a class=\"meta-classifier\" title=\"More articles about Same-Sex Marriage, Civil Unions, and Domestic Partnerships.\" href=\"http:\/\/topics.nytimes.com\/top\/reference\/timestopics\/subjects\/s\/same_sex_marriage\/index.html?inline=nyt-classifier\">same-sex marriage<\/a>.<\/p>\n<p id=\"story-continues-1\" class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"159\" data-total-count=\"1192\">\u201cWe said this at the hearing, but they just kept repeating articles that mention \u2018a man and a woman,\u2019 \u201d he said, referring to the civil affairs bureau.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"292\" data-total-count=\"1484\">The bureau cited three articles from <a href=\"http:\/\/www.mca.gov.cn\/article\/zwgk\/fvfg\/shsw\/200707\/20070700001363.shtml\">China\u2019s marriage law<\/a> and two from the\u00a0<a href=\"http:\/\/www.gov.cn\/banshi\/2005-08\/21\/content_25042.htm\">official marriage registration regulation<\/a>, he said, with four mentioning \u201ca man and a woman\u201d and one stating that a civil affairs bureau may refuse applications if it believes a couple is not qualified to marry.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"286\" data-total-count=\"1770\">\u201cBut the fact that marriage between a man and a woman is legal does not suggest that marriage between two men is illegal,\u201d he said. \u201cThis is illogical. I asked them to name one article that explicitly bans marriage between two men, but they never answered my question directly.\u201d<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"123\" data-total-count=\"1893\">The court also ruled that the couple would have to cover the litigation fee, which is 50 renminbi, or $7.70, by themselves.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"123\" data-total-count=\"1893\">The case has galvanized some gay rights advocates in China. Photographs and video taken in Changsha showed many people gathering outside the courthouse in the morning to support Mr. Sun and Mr. Hu.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"239\" data-total-count=\"2329\">The case has also received considerable attention on Chinese social media as a test of the authorities\u2019 attitude toward same-sex marriage. Internet users said that although the result was unsurprising, the couple had achieved a big step.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"187\" data-total-count=\"2516\">\u201cIn this era, being able to knock open the court\u2019s door is already a victory. Keep going,\u201d a user with the handle Garden on the Roof wrote on Weibo, China\u2019s equivalent of Twitter.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"62\" data-total-count=\"2578\">Mr. Sun said he and Mr. Hu were \u201cdefinitely disappointed.\u201d\u00a0\u201cBut after seeing so many people are paying attention to this case, we feel very hopeful,\u201d he added.<\/p>\n<p id=\"story-continues-2\" class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"193\" data-total-count=\"2875\">Li Yinhe, a Chinese sexologist who has backed same-sex marriage, said the ruling was expected. Even if the couple appealed, she said, the court was unlikely to eventually accept their argument.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"136\" data-total-count=\"3011\">\u201cMany other countries that have since allowed same-sex marriage didn\u2019t explicitly ban same-sex marriage before, either,\u201d she said.\u00a0The phone of the civil affairs bureau rang unanswered on Wednesday afternoon.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"385\" data-total-count=\"3473\">Some Chinese state-run news organizations had reported on the case over the winter, including the English-language edition of Global Times, a prominent and populist state-run newspaper. The Twitter account of People\u2019s Daily, the official newspaper of the Communist Party, <a href=\"https:\/\/twitter.com\/PDChina\/status\/720143580036145152\">posted news of the ruling<\/a> on Wednesday, using a photograph of the couple holding hands while crossing a street.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"145\" data-total-count=\"3618\">\u201cWhether I want to marry or not, it should be my right to decide,\u201d Mr. Sun, 27, said in an interview with The New York Times in late January.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"99\" data-total-count=\"3717\">Mr. Sun told his family that he is gay when he was 14 and has been a vocal supporter of gay rights.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"110\" data-total-count=\"3827\">For eight months, he ran a teahouse in southern Changsha where he gave weekly talks on sexuality and identity.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"225\" data-total-count=\"4052\">Mr. Hu, 37, a security guard, met Mr. Sun through a chat group in 2014. They said they did not spend a day apart after their first meeting. They tried to register their marriage on the first anniversary of their relationship.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"220\" data-total-count=\"4272\">A lawyer for the couple filed the lawsuit with the Changsha Furong District People\u2019s Court on Dec. 16. Court employees initially refused to accept the paperwork. But on Jan. 5, the court said it was accepting the case.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"255\" data-total-count=\"4527\">The couple said that a pair of police officers visited them in December, telling them that a married couple had an important duty to have children. The parties spoke for 40 minutes. The officers told the couple they were not acting on behalf of the court.<\/p>\n<p class=\"story-body-text story-content\" style=\"text-align: justify;\" data-para-count=\"301\" data-total-count=\"4828\" data-node-uid=\"1\">\u201cAround the world, in other places, gay people have joined forces to fight for their rights,\u201d Mr. Sun said in the interview in January. \u201cThey can get married and no longer face discrimination. Inside China, we still live a life like this.
