Flagrant Breach of Transparency and Accountability by Blue Diamond Society

Kathmandu – The National Information Commission (NIC), a revered constitutional body established to uphold the citizens’ Right to Information, has issued two stringent compliance orders against the Blue Diamond Society (BDS) for persistent violations of the Right to Information Act, 2064 (2008). Despite clear, legally binding directives, BDS has obstinately refused to disclose crucial financial, administrative, and programmatic documentation, thereby obstructing the constitutional right to transparency.

The first directive from the NIC was delivered on 2082 Kartik 20 (November 6, 2025), following a formal appeal lodged by human rights activist Numa Limbu (Chanchala). The appeal sought access to the following essential governance records:

Minutes and Resolutions of the past five Annual General Meetings (AGMs).

Official Records of all Board meetings conducted over the last five years.

Certified Annual Audit Reports for the previous five fiscal years.

Comprehensive details regarding the appointment and remuneration of all consultants and advisors.
All major Contracts and agreements executed in the past five years.

Detailed Procurement and purchase records of the organization.

Staffing details (hiring, promotion, termination) over the last five years, including selection criteria and formal decisions.

The NIC’s ruling, jointly signed by Chief Information Commissioner Dr. Suresh Prasad Acharya and Information Commissioner Durga Bhundari Paudel, explicitly condemns BDS for failing to furnish the requested information even after formal notification and granted extensions. The Commission unequivocally affirmed that this conduct constitutes a clear violation of Article 27 of the Constitution of Nepal, which guarantees the public’s right to information, and contravenes Sections 3 and 32 of the Right to Information Act, 2064.

The Commission unequivocally mandated that BDS provide all requested information within seven (7) days and ensure future adherence to all transparency obligations. BDS, however, has continuously flouted these repeated judicial orders, further cementing its pattern of secrecy, financial opacity, and profound lack of accountability.

It is utterly shameful and indefensible that an entity proclaiming to champion the rights of marginalized Gender and Sexual Minority (GSM) communities would operate under a veil of secrecy, engage in fund mismanagement, and deliberately withhold financial and governance records from the very community it purports to serve. Such unlawful behavior is not only an affront to the state’s legal framework but represents a fundamental betrayal of the ethical principles underpinning human rights advocacy.

The alarming continuation of financial support from specific international donors, who are demonstrably aware of these severe legal and ethical breaches, necessitates immediate scrutiny.

This situation raises critical questions regarding conflicts of interest and ethical negligence. These donors are urgently called upon to clarify whether their own consultants, relatives, or associated partners have derived direct or indirect financial or professional benefit from BDS projects.

The act of sustaining an organization that deliberately conceals information while exploiting the queer cause for personal or institutional gain is a profound disservice to the entire GSM movement.

Furthermore, it must be underscored that the Blue Diamond Society has deliberately excluded its own founder, Sunil Babu Pant, from every Annual General Meeting for the past 13 years, failing to share audit, financial, or governance documentation with him.

This systematic exclusion and blatant disregard for participatory governance expose a deeply entrenched culture of corruption, nepotism, and internal autocratic control.

In light of these egregious actions, we issue the following categorical demands to the Blue Diamond Society:

Immediately Release all financial, audit, and administrative documentation as explicitly ordered by the NIC.

Publicly Disclose the names, roles, and remuneration details of all consultants, contractors, and staff hired over the past five years.

Issue a sincere Public Apology to the GSM community for the violation of the Right to Information Act and the consequential betrayal of public trust.

The pursuit of equality and justice is fundamentally incompatible with corruption and pervasive secrecy.

Authentic advocacy must be immutably grounded in transparency, accountability, and integrity. Anything short of this standard is mere hypocrisy.
