काठमाडौ, १९ पौष – उज्यालो नाइन्टी नेटवर्क र नील हिरा समाजको सहकार्यमा २०६९ साउन १७ गतेदेखि नियमित प्रसारण हुँदै आएको रेडियो कमर्यक्रम पहिचान बन्द भएको छ । समलिङ्गी तेश्रोलिङ्गी समूदायको एक मात्र रेडियो कार्यक्रम पहिचान हरेक दिन दिउँसो चार बजेर १० मिनेट देखि ५ बजेसम्म प्रसारण हुँदै आएको थियो । उज्यालो नाइन्टी नेटवर्क सहित देशभरका १० वटा एफएम स्टेशनबाट प्रसारण हुँदै आएको कार्यक्रम पहिचानका लागि नेपालमा रहेको नर्वेजियन दूतावासले नील हिरा समाज मार्फत आर्थिक सहयोग गरिरहेको थियो । यस्तै नेपाल टेलिभिजनबाट प्रसारण हुँदै आएको पहिचान कार्यक्रम पनि बन्द भएको छ । रेडियो र टेलिभिजन कार्यक्रम समलिङ्गी तेश्रोलिङ्गी समूदायका सदस्यलेनै संचालन गर्दै आएका थिए ।
समलिङ्गी तेश्रोलिङ्गी समूदायको अधिकार प्राप्ती र समाजमा अरु सदस्य सरह जीवन यापनमा सहज वातावरण बनाउन रेडियो कार्यक्रम पहिचानले सहयोगी भूमिका निर्वाह गर्दै आएको थियो । हामी सबै भिन्न हामी सबै समान नारा सहित शुरु भएको रेडियो कार्यक्रम जिल्ला प्रशासन कार्यालय काठमाण्डौले नील हिरा समाजको नविकरण रोकिदिएकाले बन्द भएको हो । नर्वेजियन दूतावासले नविकरणको कागजात माग गरेको तर प्रशासनले नविकरणनै रोकिदिएकाले कार्यक्रम पहिचान बन्द भएको नील हिरा समाजले जनाएको छ ।
जिल्ला प्रशासन कार्यालय काठमाण्डौंमा नील हिरा समाजकै पूर्व कर्मचारी सिंहवहादुर लामाका नाति, इमानसिंह लामाका छोरा काभ्रे जिल्ला माझि फेदी घर भई हाल काठमाण्डु चावहिल बस्ने बर्ष ३० का विनोद लामा (जमिम शाह, जमिन राना एउटै नाम ) ले संस्थामा अनियमितता भएको भन्दै अख्तियारमा उजुरी दिएका थिए । अख्तियारबाट उजुरीमाथि छानविन गर्न जिल्ला प्रशासन कार्यालय काठमाण्डौमा पत्रचार भएको थियो । तर यो उजुरीमाथि प्रशासनले नील हिरा समाजसँग कुनै लिखित पत्राचार विना मौखिक रुपमा सम्पूर्ण कागजात मगाएर छानविन गरेको छ । छानविनको प्रारम्भिक प्रतिवेदनमा कुनै अनियमितता भएको नभेटिएको प्रमूख जिल्ला अधिकारी चुडामणी शर्माले संचारमाध्यम मार्फत बताउँदै आउनु भएको छ । उहाँले छानविन एउटा प्रक्रिया नविकरण अर्को प्रक्रिया हो भने पनि संस्थाको नविकरण रोकिदिएको घटनालाई शंकास्पद रुपमा हेरिएको छ ।
छानविन नसकिएपनि संस्थाको नविकरण हुने प्रमूख जिल्ला अधिकारी शर्माको भनाईलाई आधार मानेर डिसेम्वर महिनासम्म कार्यक्रम पहिचान संचालन भएको थियो । शर्माले डिसेम्वर अन्त्य सम्म पनि नविकरणको फाइल आफ्नै टेवुलमा राखेकाले देशभरका समलिङ्गी तेश्रोलिङ्गी समूदायको अधिकार प्राप्तीको अभियान बनेको कार्यक्रम पहचिान बन्द भएको हो ।
नील हिरा समाजलाई सहयोग गर्दै आएका दाता राष्ट्र नर्वेले सहयोग रोक्ने नभने पनि बजेट निकास नगरेपछि बाध्य भएर कार्यक्रम बन्द गर्नु परेको नील हिरा समाजले जनाएको छ । समाजले जिल्ला प्रशासन कार्यालय काठमाण्डौले छानविन गरेर सत्य तथ्य रिपोर्ट सार्वजनिक नगर्दा समाजका अरु धेरै योजना बन्द हुने अवस्थामा पुगेको जनाएको छ । अधिकार प्राप्तीको अभियान चलाइरहेको नील हिरा समाजलाई अगाडि बढ्न नदिने काममा लागेकाहरुले प्रशासन कार्यालय समेतलाई आफ्नो दवावमा पारेको शंका समाजका सदस्यहरुले गरेका छन् ।
यसैबीच नील हिरा समाजले लामो समयसम्म सरकारको मूख्य निकायले न्याय दिने नाममा लिङगरिङ गरिरहेको भन्दै श्वेत पत्र नै सार्वजनिक गरेको छ । श्वेत पत्र पढ्नुहोला ः
आदरणिय साथीहरु,
देशमा रहेका विभिन्न सीमान्तकृत अल्पसंख्यक समुदायमध्ये यौनिक तथा लैंगिक अल्पसंख्यक समुदाय (समलिंगी/तेश्रोलिंगी) पनि पर्दछन्। हाम्रो जस्तो परम्परागत र पुरातन सोचको आधारमा चल्ने समाजमा देशका विभिन्न भागमा उल्लेख्य मात्रामा रहेका यस समुदायका व्यक्तिहरू भए पनि घर,परिवार, समाज, एवम् राज्यले समेत गर्ने विभिन्न प्रकारका हिंसा तथा भेदभावका कारणले गर्दा यस समुदायका व्यक्तिहरू आफ्ना इच्छा आकांक्षालाई दभित पारी नारकीय जीवन भोगी रहेको अवस्था थियो। म स्वयं पनि यसै समुदायको भित्रको एक समलिंगी व्यक्ति भएको हुँदा यस समुदायका व्यक्तिहरूको मर्म र पिडालाई महशुस र आत्मसात् गरि यस समुदायको मानव अधिकार र स्वास्थ्यको क्षेत्रमा केही गरौँ भन्ने उद्देश्यले मेरो व्यक्तिगत पहल र प्रयासमा आजभन्दा ११ बर्ष अघि एक गैर-सरकारी संस्थाको रूपमा यस नील हिरा समाजको स्थापना गरिएको हो। संस्था दर्ताको क्रममा समुदायका साथीहरू खुलेर आउन डराउने वा नचाहने अवस्था रहेकोले सहयोग गर्ने व्यक्तिहरूको अभावमा स्वयं आफ्ना नजिकका तथा नातेदारहरू समेतलाई अनुरोध गरी यस संस्थालाई स्थापना गरेको हुँ। शुरुका दिनमा कोही पनि यस समुदायको व्यक्तिहरूको बारेमा कुरै सुन्न नचाहने र यस समुदायका व्यक्तिहरूसँग सम्पर्क नै नगर्ने अवस्था थियो। समुदायकै व्यक्तिहरू पनि आफू समुदायको हो भन्ने थाहा हुँदाहुँदै पनि खुलेर आउनसक्ने अवस्था थिएन। यस संस्थाको सम्पर्कमा आउने समुदायका व्यक्तिहरू घर, परिवार र समाजबाट अपहेलित र तिरस्कृत हुनुपर्ने अवस्था थियो। करिब एक वर्षपछि मात्र केही समुदायका व्यक्तिहरू खुलेर आउन थालेपछि संस्थाको कार्यसमितिमा रहेका मेरा नजिकका र आफन्तलाई राजिनामा दिनलगाएर समुदायका व्यक्तिहरू कार्यसमितिको सदस्य हुनुभएको कुरा यहाँ अवगत गराउन चाहन्छु। यद्यपी अथक प्रयास र संघर्षका बीच प्राप्त उपलब्धिहरूले गर्दा आज यौनिक तथा लैंगिक अल्पसंख्यकको क्षेत्रमा कार्यरत यस नील हिरा समाज एक प्रतिष्ठित गैर-सरकारी संस्थाको रूपमा स्थापित हुन पुगेको छ। यस संस्थाले देशमा रहेका यौनिक तथा लैंगिक अल्पसंख्यक समुदायको मानव अधिकार र स्वास्थ्यको क्षेत्रमा विभिन्न प्रकारका गतिविधिहरू इमान्दारिता र पारदर्शीताका साथ गर्न सफल भएको कारणले नै विभिन्न दुतावास तथा राष्ट्रिय तथा अन्तर्राष्ट्रिय दातृ निकायहरूले सहयोग गर्दै आइरहेका छन्। देशका ३८ वटा शहरहरूमा आफ्ना शाखा कार्यालयहरू स्थापना गरी करिब ७५० जनाभन्दा बढी व्यक्तिहरूलाई रोजगार प्रदान गर्न यो संस्था सक्षम भएको छ। अनवरतरूपमा इमान्दार भई संस्था र समुदायको हकहितको लागि काम गरिरहेको भए तापनि यस संस्थाबाट आफ्नो निजी स्वार्थ सिद्द गर्न नसकेका कारण संस्था छोडी गएका केही व्यक्तिहरूको पूर्वाग्रही व्यवहारका कारण आज यो लिखित भनाइ तापइहरु समक्ष राख्नु पर्दा ज्यादै नमिठो अनुभव भइरहेको छ।
संस्थाको स्थापनाकालको दौरान स्वयं यसै समुदायका व्यक्तिहरू समेत खुलेर आउनसक्ने अवस्था थिएन। संस्थाको स्थापना पश्चात् संस्थालाई कार्यालय संचालन गर्नका लागि जनशक्ति एवम् सहयोगी हातको आवश्यकता परेको थियो। त्यस समयमा यस संस्थामा कर्मचारीको रूपमा कुनै पनि व्यक्ति आउन तयार थिएनन्। तर कर्मचारी बिना यो संस्था जुन आफैँमा अधिकार प्राप्तिको अभियान थियो, अगाडी बढाउन र कार्यालय संचालन हुन नसक्ने अवस्था थियो। त्यसमा पनि लेखा सम्बन्धी काम गर्न प्राविधिक ज्ञान भएको व्यक्तिको संस्थालाई टड्कारो आवश्यकता परेको थियो। लेखा शाखा हेर्ने कर्मचारीको अभावमा संस्थाको गतिविधिहरू संचालन गर्न कठिनाई परिरहेको अवस्थामा संस्थागत अनुरोधमा हाल लेखा-प्रमुखका रूपमा कार्यरत श्री बिष्णुराज पन्तले यस संस्थामा आवद्ध भै काम गरिदिनुभएको हो। यस संस्थामा स्वयं सेवकका रूपमा आउनुभन्दा पूर्व उहाँ नेपाल उद्योग बाणिज्य महासंघजस्तो महत्वपूर्ण संस्थामा सह-सचिवस्तरको पदमा कार्यरत हुनुहुन्थ्यो। उहाँले सम्बन्धित बिषयमा स्नातोकोत्तरसमेत गरेको, लेखासम्बन्धी तालिमहरूसमेत प्राप्त गरी उच्च दक्षता हासिल गर्नुभएको छ। नेपाल उद्योग बाणिज्य महासंघजस्तो ठूलो संस्थामा लेखा विभागको सह-सचिवस्तरको पदमा कार्यगरी सकेका व्यक्तिलाई संस्थाले अनुरोध गरी यस कार्यालयमा काम गरिदिन गरेको अनुरोध स्विकार गरी आजसम्म यस संस्थामा अनवरतरूपमा इमान्दारीताका साथ सेवा गरिदिनुभएकोमा यस संस्थाको कार्यसमितिले समेत उहाँको योगदानको प्रशंसा गरेको छ। यस संस्थामा कुनै आर्थिक स्रोत नभएको बेलासमेत सुरुमा उहाँले स्वयंसेवकको रूपमा बिना पारिश्रमिक काम गरी यस संस्था र समुदायलाई ठूलो गुन लगाउनुभएको छ। यसरी स्वयंसेवकका रूपमा प्रवेश गर्नुभएका निज बिष्णुराज पन्त FHI Project को लेखा अधिकृत र त्यस पछि अन्य PSI सहित Core Fund केही बर्ष हेरेको र त्यसपछि FHI को छुट्टै लेखा अधिकृत नियुक्ति भएको र Core Fund र अन्य परियोजनाको लेखासमेत अन्यलेखा अधिकृतहरुले हेर्दै आउनुभएको छ।
यस संस्थामा विभिन्न दातृ निकायको सहयोग रहेको छ। हरेक दातृ निकायको आ-आफ्नो परियोजनाहरू संचालित छन्। हरेक परियोजनाका आ-आफ्नै परियोजना प्रमुख र लेखा अधिकृत रहेकाछन्। प्रत्येक परियोजनाको छुट्टाछुट्टै हिसाब राख्ने गरिन्छ। दातृ निकायले आ-आफ्नो परियोजना अन्तर्गतको लेखाको चार्टड एकाउन्टेनमार्फत् लेखापरिक्षण गर्दै आईरहेका छन्। समय-समयमा दातृ निकायहरू र समाज कल्याण परिषद्समेतले अनुगमन तथा मूल्याङ्कन गर्ने गरेका छन्। हालसम्म कुनै पनि परियोजनाको लेखापरिक्षकले संस्थामा आर्थिक अनियमितता भएको औंलाएका छैनन्। अतः हरेक परियोजनाको आ-आफ्नै लेखा राख्ने प्रणाली रहेको यस संस्थामा केवल अनुभव र दक्षता हासिल गरेको पुरानो कर्मचारीका रूपमा लेखा प्रमुख बिष्णुराज पन्तले संयोजन गरिदिने मात्र काम गर्नुहुन्छ। सामान खरिदसमेत खरिद समितिद्वारा कोटेशन जम्मा गरी सो समितिको सिफारिसमा मात्र सामान खरिद गर्ने गरिन्छ। कार्यसमितिबाट स्वीकृत आर्थिक नियमावली र कर्मचारी नियमावलीअनुसार नै आर्थिक र कर्मचारी प्रशासन चल्ने गरेको छ। त्यसैगरी हरेक परियोजनाको आ-आफ्नै परियोजना प्रमुख हुनेहुँदा मेरो स्वयं पनि त्यसमा कुनै भूमिका रहँदैन।
पुनश्च: संस्था स्थापनाको लागि दु:ख परेको बेला संस्था संचालनार्थ बिना पारिश्रमिक सेवा गर्नसमेत तत्पर रही हालसम्म कार्यरत लेखाप्रमुख बिष्णुराज पन्तप्रति यस्तो आरोप लगाइनु ज्यादै निन्दनीय छ।
आर्थिक अनियमितता भएको सम्बन्धमा सगरमाथा टेलिभिजनले गलत सूचना र तथ्यहीन कुराको आधारमा पूर्वाग्रही भै यस संस्था र संस्थामा आवद्ध म लगायतका पदाधिकारीलाई लगाइएको आरोपका सम्बन्धमा पत्रकार आचारसंहिता विपरित कार्यगरेको भनी यस संस्थाको तर्फबाट उजुरीसमेत दर्ता गरिएको र उक्त उजुरी उपर प्रेस काउन्सिलले छानविन गरिरहेको व्यहोरासमेत अनुरोध गर्दछु। सगरमाथा टेलिभिजनले संस्थाको इज्जत र प्रतिष्ठामा आँच आउने कार्यक्रम प्रशारण गरेको भनी यस संस्थाको तर्फबाट प्रेस काउन्सिलमा दर्ता गरिएको उजुरी उपर वास्तविकता बुझ्न प्रेस काउन्सिलले उक्त टेलिभिजनलाई पत्राचार गर्दा पनि कुनै जवाफ नदिएको भनी प्रेस काउन्सिल नेपाल अन्तर्गतको आचार-संहिता अनुगमन तथा सम्वाद उपसमितिको बैठकबाट पुन: ध्यानाकर्षण गराई खण्डन प्रसारणसहित जानकारी पठाउन भएको निर्णय बमोजिमको मिति २०६९०६२२ च.नं. २७६०६९७० को पुन:ध्यानाकर्षण पत्र जारी गरिएको छ, तर सगरमाथा टिभिले भने आफ्नै तालमा मेरो चरित्र हत्या गरीरहेको छ।
(यौनिक तथा लैंगिक अल्पसंख्यक समूदायका साथीहरुलाइ समेत टिभिमा मेरो विरूद्धमा बोल्न प्रलोभन दिने तथा धम्काउने काम समेत भइरहेको छ केहि पत्रकारहरुवाट, नीलहिरा समाजको तथा मेरो पक्षमा बोल्ने साथीहरुले धम्कि तथा कुटपिट समेत खेप्नु परेको छ। पत्रकार माहासंघलाइ पनि जानकारी गराइएको छ यस विषयमा ।)
यस संस्था अन्तर्गतका हरेक दातृ निकायअन्तर्गतका आ-आफ्नो परियोजना र कार्यक्रम रहेको र प्रत्येक परियोजनाहरू आ-आफ्नो कार्य गर्न स्वतन्त्र र स्वायत्त छन्। परियोजनाको संयोजक र सम्बन्धित लेखाका कर्मचारीहरूको निर्णयबाट सोसम्बन्धी कार्य सम्पन्न हुने गर्दछ। त्यसमा व्यक्तिगतरूपमा मेरो कुनै हस्तक्षेप हुँदैन। मैले कार्यक्रमप्रति सुझाव दिने र यदि मेरो विशेषज्ञता बमोजिमको कुनै कार्य गर्न मेरो संलग्नताको आवश्यकता महसुस गरी अनुरोध गरिएका बाहेक मेरो कुनै परियोजनामा संलग्नता हुँदैन।
समुदायको मानवअधिकार तथा स्वास्थ्यको क्षेत्रमा गरेको उल्लेख्य कार्य गरेबापत दातृ निकायको सहयोगमा यस संस्थाको नाममा उक्त ठाउँमा पुरानो घर र जग्गा किनिएको कुरा साँचो हो। पुरानो भवन जीर्ण भएकोले उक्त जग्गामा संस्थाको लागि नयाँ भवन बनाउने सम्बन्धमा संस्थाले दातृ निकाय र नेपाल सरकारसँग सहयोग माग गरी अघि बढाएको हो। उक्त भवन बनाउनका लागि नक्सापास गर्ने सम्बन्धमा नील हिरा समाजको कार्यसमितिको मिति २०६७ साल मंसिर ६ गते बसेको बैठकले “यस नील हिरा समाजको नाममा दर्ता श्रेस्ता कायम भएको का.जि.का.म.न.पा.-४ मा रहेको कि.नं. २६६ र २९७ को सम्पूर्ण जग्गामा नयाँ घर निर्माण गर्न यस संस्थाका कार्यकारी निर्देशक d सुनील बाबु पन्तको नाममा नक्सापास गरी निजकै नाममा सम्पूर्ण नक्सापास प्रमाण पत्र जारी गर्ने” भन्ने निर्णय गरेको रहेछ। (प्राविधिक कारण: संस्थाको नाममा नक्सा पास गर्दा चारै तिर १० फिट खालि छाड्नु पर्ने तर व्याक्तिका नाममा जग्गा धनिको मन्जुरिनामा लिएर, नक्सापास गर्ने प्रावधान रहेकोछ। नीलहिरा समाजको हाल निर्माणाधिन भवन रहेको जग्गा जम्मा ६ आना जति छ र त्यो पनि भिरालोमा रहेको कारण संस्थाको नाममा भबनको नक्सा पास हुन सक्ने स्थिति थिएन। जग्गा नील हिरा समाजकै स्वामित्वमा रेहेको छ।) कार्यसमितिको उक्त निर्णय मलाई मिति २०६९/०८/०६को पत्रमार्फत् जानकारी गराइएको थियो। संस्थाको स्वामित्वमा रहेको जग्गामा कार्यसमितिको निर्णय बमोजिम कार्यकारी प्रमुखको हैसियतमा निर्माणाधिन उक्त भवन मेरो व्यक्तिगत हो भनी आरोप लगाउनु कानुनसम्मत पक्कै होइन। काठमाडौँ महानगरपालिकाले नियम बमोजिम मिति २०६८/०३/२३को टिप्पणीअनुसार नक्सापास गरी मेरो नाममा इजाजतपत्र (License) जारी गरेको हो। हाल भवन निर्माणको कार्य अन्तिम चरणमा पुगेको छ। यस सम्बन्धमा संस्थाको प्रमुख कर्मचारीको हैसियतले कार्यसमितिको निर्णयलाई पालना गरेको मात्र हुँ। यसमा मेरो कुनै बद्नियत थिएन र छैन। नील हिरा समाज एउटा संस्थामात्र नभई सम्पूर्ण यौनिक तथा लैंगिक अल्पसंख्यकहरूको साझा अभियान हो। यस अभियानको नेतृत्वकर्ता एवम् पूरा जीवन नै यसै अभियानप्रति समर्पित गरेको म जस्तो व्यक्तिले व्यक्तिगत लाभको नियत राख्ने कल्पना पनि गर्न सक्दिन। त्यसैले म प्रति लगाइएको यो आरोप पूर्वाग्रहमात्र भएको व्यहोरा अनुरोध गर्दछु।
समाजमा सिमान्तकृत अवस्थामा रहेका घर, परिवार, समाज र राज्यबाट समेत विभेदमा पारिएका आफ्ना इच्छा र आकांक्षा एवम् चाहनालाई समेत सामाजिक मूल्य र मान्यता एवम् अन्य कारणले प्रस्फुटित हुनबाट बन्चित भै बसेका यौनिक तथा लैंगिक अल्पसंख्यक समुदायको हक, अधिकार, स्वास्थ्य तथा सशक्तिकरणका लागि बिषम परिस्थितिमा पनि “नील हिरा समाज” नामक संस्था दर्ता गरी इमान्दारिताका साथ क्रियाशील रही यस समुदायको क्षेत्रमा सक्दो र उल्लेख्य काम गरेकोले देशमा सम्पन्न भएको संविधानसभाको निर्वाचनमा मलाई पनि सार्वभौम सम्पन्न संविधानसभाको सदस्यका रूपमा ने.क.पा.(संयुक्त)द्वारा मनोनित गरिएको हो। यसरी एक समुदायको अधिकार प्राप्तिको महान् अभियानमा सक्रिय भए वापत मलाई संविधानसभाको सदस्य जस्तो सम्मानित र गरिमामय पदमा मनोनित गरिनुले नै समुदायप्रति मेरो योगदानको कदर गरेको मैले अनुभूति गरेको छु। यसरी संविधानसभाको सदस्य मनोनित भै सकेपछि मैले राज्यलाई समेत समय दिनुपर्ने भएकोले यस नील हिरा समाजको कर्मचारीको रूपमा रही रहन नसक्ने अवस्था भएकोले २०६५ असार २ गते मैले राजिनामा दिएको थिएँ। राजिनामा पश्चात् म केवल संस्थाको सल्लाहकारको रूपमा मात्र रहेको थिएँ। तर मेरो अभावमा संस्थाका गतिविधिहरू संचालन गर्नमा कठिनाई उत्पन्न भएको र संस्थासमेत चलाउन गार्हो परेको भनी संस्थाको कार्यसमितिको २०६५ असोज १६ गतेको बैठकले पुनः कार्यकारी निर्देशकको रूपमा कार्य गरिदिन आग्रह तथा निर्णयसमेत गरी पत्राचार गरेकोले मैले मेरो जीवन नै यस समुदायको हक, हित र अधिकार प्राप्तिको निम्ति समर्पण गरिसकेको हुँदा, कार्य समितिले समेत निर्णय गरिसकेकाले संविधानसभामा दिने समयको अतिरिक्त समयसमेत कार्य गर्ने गरी पुनः कार्यकारी निर्देशकको रूपमा विभिन्न परियोजनाहरूको समन्वय गर्ने र सल्लाह सुझाव दिने जस्ता कार्यहरू सम्पन्न गरेको हुँ। (सरकारि स्रोत वाहेक अन्य स्रोतवाट दोहोरो वा थप सुबिधा लिन कानुनले कुनै रोक लगायको पाइंदैन, साथै पार्टिलाइ रू १५००० हरेक महिना लेवि वापत बुझा्नु पर्ने वाध्यता थियो, चाहेर नचाहेर दोहोरो सुविधा लिनुनै पर्ने थियो। )
कुनै पनि परियोजनाको पूर्णकालीन कर्मचारीको रूपमा म रहेको छैन। विशेषज्ञ सेवा उपलब्ध गराउने गरी केही प्रतिशत सेवा शुल्क लिई काम गरेको हुँ। समलिंगी/तेस्रोलिंगी व्यक्तिहरूको बारेमा बृहत्तर अध्ययन गरेको तथा यसै क्षेत्रमा एक दशकदेखि देश-विदेशमा समेत कार्य गरेको साथै यस अभियानको नेतृत्वकर्तासमेत भएको कारणले मैले आर्जन गरेको ज्ञानलाई समुदायको हितमा लगाउने गरी मैले संस्थामा निरन्तरता दिएको हुँ। यस संस्थामा कार्यकारी निर्देशकको रूपमा कार्यरत रहे पनि संविधान निर्माण प्रक्रियामा संविधानसभामा सक्रियरूपमा सहभागिता जनाएको थिएँ। मेरै सक्रियतामा संविधानसभाको विषयगत समितिको प्रतिवेदन तथा अवधारणापत्रहरूमा यौनिक तथा लैंगिक अल्पसंख्यक समुदायको अस्तित्व स्वीकार गरी अधिकारको व्यवस्था गर्ने प्रावधानहरूसमेत समावेश भएका थिए। तर दुर्भाग्य संविधानसभाको ४ वर्षको उपलब्धी संविधानसभाको विघटनसँगै अर्थहीन हुनपुग्यो।
अतः यसरी संस्थाको अनुरोधमा संविधानसभाको काममा कुनै बाधा नपर्ने गरी यस संस्थामा विशेषज्ञको रूपमा सेवा प्रदान गर्ने गरी यौनिक तथा लैंगिक अल्पसंख्यक समुदायको अभियानकर्ताको रूपमा क्रियाशील रहेर यस संस्थामा असल मनसायले सहभागिता जनाएको व्यहोरा अनुरोध गर्दछु।
अन्तमा यस संस्थामा रही आर्थिक अनियमितता गरी काठमाडौंमा घर सम्पत्ति तथा गाडीसमेत जोडेको भनी लगाइएको आरोप झुठा हो। मैले संस्थालाई दुरुपयोग गरी कुनै पनि ठाउँमा निजी सम्पत्ति जोड्ने र व्यक्तिगत मुनाफा हुने व्यापारमा लगानी गरेको छैन। मैले हाल चढी आएको गाडी १० वर्ष पुरानो हो र मेरो शुभ चिन्तकले न्यून मूल्यमा उपलब्ध गराइदिएका हुन्। काठमाडौंमा मेरोनाममा कुनै घर जग्गा छैन।
तथ्यहरु:
नील हिरा समाजको हरेक साल Audit हुन्छ, योसाल पनि भएको छ, Tax कानुन वमोजोम बुझाइएको छ।
२०१२ सालमा जम्मा प्राप्त रकम करिव रु ११,०००,००० छ। देश भरि ७५० जना कर्मचारिहरु छन्। विभिन्न तहका कर्मचारि रहे बमोजिम जिम्मेवारि, सेवा सुबिधा समेत फरक फरक रहेका छन। संस्थाको नियमावलि अनुसार अल्पकालिन कर्मचारिहरु जो हप्ताको १ दिन मात्र अफिस आए पुग्छ र दिनको २ घण्टा मात्र काम गर्छन उनिहरुको ज्याला महिनामा करिव ४००० रू छ।
पुर्णकालिन कर्मचारिहरुको तलव महिनामा नूनतम ८००० रु देखि सुरु भएर रू १००००, १२०००, १५०००, २००००, ३००००, ३५०००, ४००००, ५००००, ६००००, ७००००, ८०००० हुंदै रू १४०००० सम्म रहेको छ।
४० जिल्लामा मानव अधिकार तथा HIV रोकथाम कार्यक्रम चलिरहेका छन्।
जिल्ला प्रसासन कार्यालयमा संस्था नविकरणको प्रकृया लामो समय देखि रोकिएको छ। CDO वाट जवाफ पाइएको छैन। कार्यक्रमहरु बिस्तारै रोकिइन थालेक छन।

Respected friends,
Sexual and gender minorities (homosexuals/transgender) are one of the many kinds of minorities present in Nepal. Due to conservative socio-cultural societal traditions and the unhelpful attitude of the state, sexual and gender minorities have historically been stigmatized and discriminated against and have faced violence. They had been suffering a lot. As a gay/homosexual person who has experienced the challenges of this community, I understand the injustice and difficulties we have faced. So eleven years ago, I founded Blue Diamond Society as a non-governmental organization to advance the human rights and provide public health facilities to sexual and gender minorities.
It was difficult to enlist sexual and gender minority (also referred to as ‘community’ or SGM) people during the process of registering Blue Diamond Society (BDS) as most were not open about their gender identity and were afraid of being exposed. Due to the lack of other members of the community during the registration process, I requested some relatives to join in becoming founding members of BDS.
During the initial days of us starting work no one was willing to hear about the plight of this community or to have any contact with us. Even those people who knew about their gender identity as a SGM were not in a position to be open about it. Those community members that dared contact us were often subjected to ostracism and intimidation by their family, relatives, and society. It was only after about a year of BDS starting operations that some closeted community members became open about their gender identity. I then asked my relatives to resign their board positions, which were taken up by some community members who had become open about their status.
Due to the hard efforts and struggle we have undertaken, today Blue Diamond Society has become a leading non-governmental organization of Nepal. We have successfully run a variety of programs to improve the human rights and provide greater access to public health facilities for sexual and gender minorities. It is due to this excellent track record of achievement that a variety of bilateral and multilateral donor agencies and government agencies have been so supportive of our work.
BDS affiliates are operating in 39 cities and we provide employment to over 750 people. Despite our honest and hard work for the sake of the community, I am regretfully presenting this written statement to you today to counter the false and damaging allegations leveled against me and BDS by disgruntled former employees who acted out of malice and personal enmity.
Almost no one was in a position to be open about their sexuality during the time that this organization was established. We were in dire need of qualified human resources at that time but very few people were willing to work for it. As a result we had great difficulty running operations. We lacked a person to handle accounting and finance, so the current head of finance Bishnu Raj Pant volunteered to handle these responsibilities when requested by BDS. Prior to volunteering for us, Mr. Pant had been working in the senior position of Under-Secretary at the Nepal Industrial Finance Cooperative. He was very qualified for the position as he possesses a master’s degree in a relevant field and has taken various kinds of accounting training where he achieved distinction. Mr. Pant has honestly and competently handled his responsibilities at BDS after relinquishing his senior position as an Under-Secretary at the Nepal Industrial Finance Cooperative and our board has praised his performance. By starting work as a volunteer and by serving until today, Mr. Pant has made a huge contribution to the advancement of our community. He served as an accounts executive under a FHI project then after was paid by various PSI, Core Fund, and FHI projects.
We receive funding from various donor agencies. Each donor agency has its own programs and regulations. For every donor funded program, we keep separate accounts and each donor enlists a chartered accountant to account for expenditures. From time to time, the Social Welfare Council (SWC) and donor agencies carry out separate checks of our expenses. No chartered accountant has ever accused our organization of financial mismanagement. This demonstrated that Bishnu Raj Pant has handled our finances well due to his tremendous experience and ability. For purchases and requisitions, a purchasing committee collects quotations and then recommends the best vendor depending on price and quality. Similarly, all human resources and finance matters are handled as per the respective policies passes by the board. And as all programs have their own heads, I play no role in directly managing them. Given all this, it is deplorable that shameful charges of mismanagement and corruption have been leveled against Bishnu Raj Pant.
Sagarmatha Television has disseminated false and baseless accusations against the organization and its senior leaders and board members in a media campaign. I would like to inform you that we have lodged a complaint with the Nepal Press Council which is investigating the TV channel. The Press Council has ordered Sagarmatha TV to furnish a explanation but the latter has not done so. The Investigation Subcommittee of the Press Council in letter no. 273/069/70 dated 2069/06/22 had ordered Sagarmatha TV to submit a clarification but the channel has ignored this order and continued to engage in a campaign of character assassination against me.
(Sexual and gender minority friends have been coerced into speaking against me and BDS by Sagarmatha TV while those community members speaking for us have been intimidated and violently attacked. The Press Council has also been made aware of this.)
Each program’s coordinator and finance officer run the respective donor funded program without any involvement by me. All I do is give advice and technical input when requested.
Due to the aging of our current building, the Nepal government and donor agencies gave funding for a new building. To get the building plan for the new office approved, a board decision dated Mangsir 6, 2067 declared that “The ownership of property belonging to Blue Diamond Society at Ka.Ji.Ka.Ma.Na.Pa. – 4 on K.Ni. 266 and 277 (Plots) is hereby transferred to Executive Director Sunil Babu Pant.” (The reason for this: To build an office building under ownership of BDS, the prevailing laws would require us to leave ten feet of empty space on each side while no such law applied to personally owned property. The property on which BDS is constructing its new office is less than six annas in size, and it is located next to a steep cliff. As such, we would be unable to build an office if it were to be under BDS’ ownership. Throughout the entire process of construction, the land has been owned by BDS.)
This decision of the board was communicated to me through a letter on 2069/09/06. Allegations that the office building being built on BDS-owned land belong to me are plain false. According to a notice dated 2069/03/23 issued by the Kathmandu Municipality, only the license for constructing an office building is in my name. At the moment, construction of the building has reached its final stages. I own the building only as an interim measure until construction is complete as per the board decision and I do not and have never had designs to own it permanently. BDS is not just an organization; it is a common undertaking of all sexual and gender minorities. As someone who has given my life for this community and founded BDS, I cannot even imagine stealing something that belongs to the organization. Therefore I call on everyone to not believe the malicious allegations that have been made against me.
SGM have been denied their rights and prevented from fulfilling their wishes to be true to themselves by family, relatives, society and even the state. In such a situation, the organization called “Blue Diamond Society” was registered to help this community seek rights, health, and empowerment. In recognition of these achievements, I was nominated as a member of Nepal’s erstwhile Constituent Assembly cum Parliament by the Communist Party of Nepal (United). Getting nominated to such an august body was by itself a huge achievement for our community. But then my duties and responsibilities to the state grew and I was unable to give my full energy to the organization so on 2065 Asar 2, I submitted my resignation to BDS. But citing an inability to operate the organization without my leadership, a board meeting on 2065 Asar 16 requested me to withdraw my resignation. As I had given my life to the cause of the rights of SGM, I decided to continue in my role as executive director. (With the exception of government positions, no law bars a government official from earning income privately. Additionally, Rs. 15,000 of my monthly income was taken by my party “as levy” and I had to take the pay as a Member of the Constituent Assembly (CA) regardless of whether I wanted it because the party needed a portion of it.)
I have not held a position as an employee of any other entity. The only times I take a fee is when I give lectures that are specialized and technical in nature. I have contributed my expertise on SGM issues at conferences in Nepal and abroad for the last decade. Despite all my work as executive director, I was an active contributor to the constitution drafting process. It was also an honor for me to press for equal rights for SGM to be included in the draft constitution’s provisions. It was very unfortunate that the CA’s term expired after its inability to write a new constitution over a period of four years.
In conclusion, I declare that I fulfilled my role of executive director at BDS without allowing it to infringe on my duties as a member of the CA.
Finally, I declare that the accusations against me saying that I obtained a house and a car by engaging in financial irregularities at BDS are false. I have never pilfered funds from the organization and used those to acquire private property or make investments. The car I currently drive is ten years old and was sold to me at a discounted price by a well-wisher. There are no houses or property in my name anywhere in Kathmandu.
The facts are:
Request: It is necessary to keep Blue Diamond Society and Nepal’s sexual and gender minority community’s quest for human rights alive. We need all of your support today.
What you can do now: Call Chief District Office (CDO) to renew BDS’s licence without further delay, release CDO report of BDS investigation, as the investigation started about 4 months ago and the CDO office told us that the draft report to be signed by chief district officer was ready for about 2 months ago. Call press council and federation of Nepalese journalists to take action on sagarmatha TV and other journalists who are abusing and harassing human rights defenders and LGBTI community.
Ultimately call Nepal Government to intervene if CDO do not renew BDS’s licence immediately. We suspect now that some people are trying hard to let BDS and LGBTI movement in Nepal to die just like this….
