Incorporate rights of LGBTI in civil and criminal code : Thapa  

Kathmandu (Pahichan) September 30 – Advocate and Legal Advisor to Blue Diamond Society Prem Bahadur Thapa has suggested incorporating the rights of gender and sexual minority in the Civil and Criminal Code.

At a discussion organized by Legislature Committee of Parliament, Thapa said laws have not addressed the rights of this community. The Committee had organized a meeting with stakeholders to solicit their views in the draft of laws. He suggested incorporating the sexual orientation in the laws.

Thapa suggested allowing the same-sex marriage considering the report submitted by a committee on same-sex marriage. He suggested not incorporating only son and daughter but also adopted son and children.  He said despite the Supreme Court order, there has been delay in the formation of laws.

He also highlighted the role played by Sunil Babu Pant. “According to Supreme Court order, members of this community are receiving passports and citizenship as per gender identity but there has been delay in the formulation of laws,” said Thapa.  He questioned that as male and female has been mentioned in the civil and criminal code it would invite complications if others also get such document.

He said BDS has filed a complaint at Supreme Court demanding that citizenship should be allowed changing the identity but there has not been any hearing on it.
